Children and Beneficiaries

If you have children, your Wills will be drafted to establish a testamentary trust for each child’s benefit. A testamentary trust is a trust created after your passing and requires no administration or tax returns during your lifetime. The testamentary trust is held for the benefit of each of your children until they reach age twenty-five. This allows for a trustee to manage a child’s inheritance until they reach a mature age. Any child who is already twenty-five when the survivor of you dies will receive their share of your estate outright.

Please remember, if you are married, this estate planning tool will leave your estate to your spouse. The distribution of property you determine on this page will only happen if your spouse dies before you do. This section allows you to name a beneficiary to receive your assets upon your death through your last will and testament. A beneficiary may be an individual or a charity. In the event your beneficiary predeceases you, please select either the per stirpes or per capita designation. Signing Your Documents

Pennsylvania law requires that your documents be notarized and witnessed by two disinterested individuals to be self-proving (for the Will) and valid (for the Financial Power of Attorney). If the documents are not signed properly, there is a risk that they will not be legally valid documents. We will send you a federal express package with your documents ready to be executed. We will provide you with written instructions and are available to answer any of your questions regarding signing your documents. You will need to find and provide your own notary and two witnesses who are not named in your documents. We recommend going to your local bank if they offer this service, or going to your local UPS store, which has notaries on staff and can often provide witnesses as well.
